The Intellectual Property (IP) practice group at INDUSLAW advises diverse clients from start- ups to large corporations across varied sectors. The IP Practice team at INDUSLAW consist of individuals who are not only proficient at building, protecting and enhancing IP rights for their clients but also passionate about doing so. The team is well experienced and adept at working with different IPs including trade marks, copyrights, designs, geographical indications and patents.

Our support to clients extends not just in India, but across the Indian Sub-Continent and in other parts of the world as well.

The team’s specialized offerings include:       

IP ideation, identification and protection- Assisting our clients in identifying the right IP for their business, strategizing on the optimum form(s) of IP protection, conducting searches to ascertain availability to register and use IPs, as well as freedom to operate/use clearance searches, and taking steps to register the IP with the relevant authorities.

 Contentious matters (non-litigation)- Handling varied types of contentious matters before different forums, as well as devising commercially driven enforcement strategies. This includes handling oppositions and rectifications before IP Offices and Courts, as well as enforcement of rights through the Internet including domain name transfer/cancellations and take-down-stay-down requests, and enforcement of rights at international borders through the Indian Customs.

IP Litigation and Dispute Resolution- Appearing before various Courts in India assisting clients in enforcing and defending their IP rights, both on the civil and criminal side. The team handle complex litigations involving different IPs and are also adept at strategizing and executing anti-counterfeiting and anti-piracy enforcement actions on behalf of clients. The team also work closely with different enforcement authorities in executing litigation strategies and enforcement actions.

IP commercial and transactional support- Supporting clients on complex and large commercial transactions and strategizing on the best mechanism to commercialize IP. While proficient in conducting audits and due diligence, the Team also routinely advise clients in structuring their IP in acquisition, investment and other commercial transactions, as well as in matters concerning sale/license of trademarks, licensing of content, software development agreements, technology transfers and patent and know-how licenses.
